2. PURPOSE AND SCOPE

These Terms and Conditions regulate the use of the website https://homebutcher.shop/ and the purchase of products through the e-commerce platform of Cerrado Verde - Comércio E Indústria De Carnes, S.A, hereinafter referred to as "www.homebutcher.shop".

The use of this website implies full acceptance of these Terms and Conditions.

3. PRODUCTS AND SERVICES

3.1 Product Description

The available products are those listed in the online catalog.
The features, specifications, and prices are those indicated at the time of the order.
The Seller reserves the right to change or discontinue products without prior notice.

3.2 Availability

Product availability is subject to existing stock.
In case of unavailability, the Customer will be contacted within 48 hours.

4. PRICES AND PAYMENT

4.1 Prices

All prices include VAT at the legal rate in force.
Prices may change without prior notice.
The applicable price is the one in force at the time of order confirmation.

4.2 Payment Methods

Ref. Multibanco, MB WAY, Credit Card, Bank Transfer, Bank Deposit (1-2 days for validation).
Payment must be made at the time of the order.
The order will only be processed after payment confirmation.

5. ORDERS AND PURCHASE PROCESS

5.1 Order Process

The purchase process follows these steps:
- Product selection
- Add to cart
- Filling in billing and delivery details
- Choosing the payment method
- Order confirmation.

5.2 Special Requests

If you wish to make a specific request, such as a custom meat cut or to indicate a preferred delivery date, you can do so by adding notes to your order during the purchase. We will do our best to accommodate your request, always subject to our confirmation.

5.3 Confirmation

After completing the order, the Customer will receive a confirmation by e-mail. The order is considered accepted after this confirmation is sent.

6. DELIVERY

6.1 Delivery Times

Deliveries are made within 24 to 48 hours after dispatch, counted from the payment confirmation.

You will receive an email or SMS on the day of delivery.

Example: orders placed between 3 PM on Friday and 3 PM on Monday are delivered the following Tuesday.

6.2 Shipping Costs

We deliver for free throughout mainland Portugal, but there is a minimum order value per delivery zone.

6.3 Carriers

Deliveries are handled by our internal distribution or by DPD Fresh, ensuring the cold chain for all orders.

6.4 Delivery Location

Delivery is made to the address indicated by the Customer. Someone must be present at the location to receive the delivery at the suggested times.

Alternatively, you can indicate in the order notes that you prefer to collect at our facilities. The facilities are not open to the public, operating exclusively as a collection point by prior appointment.

7. RIGHT OF FREE RESOLUTION (Law no. 144/2015)

7.1 Period

The right of free resolution (14 days after receipt) does not apply to products liable to rapid deterioration, such as fresh and frozen meat, in accordance with article 17, no. 1, paragraph d) of Decree-Law no. 24/2014. The Customer has the right to terminate the contract at the time of delivery by communicating to the Driver/distributor and submitting proof on the same day of delivery.

7.2 Exercise of the Right

Written communication (e-mail, letter) by the end of the period.
Use of the free resolution form (available on the website).

7.3 Return of Products

Portuguese legislation stipulates that perishable products such as fresh and frozen meat, due to their susceptibility to rapid deterioration, generally cannot be returned due to simple regret, except in cases of manufacturing defect, improper storage, or contractual breach in distance selling.

Exceptions to the impossibility of return
The return of fresh or frozen meat is only mandatory for the merchant if the product is defective, unfit for consumption, or does not correspond to what was contracted (for example, meat delivered in poor condition or different from what was ordered).

In distance sales (for example, online purchases), the right of free resolution (14 days after receipt) does not apply to products liable to rapid deterioration such as fresh and frozen meat, in accordance with article 17, no. 1, paragraph d) of Decree-Law no. 24/2014.

Therefore, we recommend checking it immediately after receiving the goods in their original condition, with packaging and labels.

Return costs borne by the Customer (except for defects).

7.4 Refund

Refund within 1-2 days, after written complaint to the email encomendas.online@cerradoverde.pt in case of any non-conformity upon receipt.
Same payment method used in the original purchase.

7.5 Exceptions

The right of free resolution does not apply to:
Customized or tailor-made products.
Perishable products or those with a short expiry date.

8. WARRANTIES

8.1 Legal Warranty

As these are fresh and frozen products, the following rules apply: It does not apply to products liable to rapid deterioration, such as fresh and frozen meat, in accordance with article 17, no. 1, paragraph d) of Decree-Law no. 24/2014.

9. PERSONAL DATA PROTECTION (GDPR)

9.1 Data Controller

Cerrado Verde - Comércio E Indústria De Carnes, S.A. is the data controller for personal data.

9.2 Purposes

Data is collected for:
Order processing.
Commercial relationship management.
Compliance with legal obligations.

11. LIABILITY

The Seller's liability is limited to the value of the products sold, except in cases of fraud or gross negligence.

11.2 Force Majeure

The Seller is not responsible for non-compliance resulting from force majeure or unforeseeable circumstances.

The Seller reserves the right to amend these Terms and Conditions, and must communicate any changes 30 days in advance.

13.2 Validity

If any clause is deemed invalid, the remaining clauses shall remain in force.
